Welcome to Family Roots ("we", "us", "our"). These Terms of Service ("Terms") govern your access to and use of the Family Roots website, including any content, functionality, and services offered on or through the website (the "Service"), such as the Healing Tales feature. Please read these Terms carefully before using the Service.

By accessing or using the Service, you agree to be bound by these Terms and our Privacy Policy (available at https://fam-roots.com/en/privacy). If you do not agree to these Terms or the Privacy Policy, you must not access or use the Service.

2. Eligibility

You must be at least 18 years old or the age of legal majority in your jurisdiction to create an account and use certain features of the Service, including generating Healing Tales. Users under the age of 16 are prohibited from using the Service.

3. User Accounts

• Registration: To access certain features, you may need to register for an account. You agree to provide accurate, current, and complete information during registration and keep your account information updated.
• Security: You are responsible for safeguarding your account password and for any activities or actions under your account. You agree to notify us immediately of any unauthorized use of your account.
• Termination: We reserve the right to suspend or terminate your account at our discretion, without notice or liability, for conduct that violates these Terms or is harmful to other users, us, or third parties, or for any other reason.

4. Use of the Service

You agree to use the Service only for lawful purposes and in accordance with these Terms. You agree not to:

• Violate any applicable laws or regulations.
• Infringe upon the rights of others, including intellectual property rights.
• Transmit any harmful, threatening, abusive, defamatory, obscene, or otherwise objectionable material.
• Interfere with or disrupt the Service or servers or networks connected to the Service.
• Attempt to gain unauthorized access to any portion of the Service or any other accounts, computer systems, or networks.

You are responsible for managing your browser's notification permissions. We do not guarantee delivery of all notifications, as this depends on browser and device support. You may unsubscribe from push notifications at any time via your browser or your profile settings.

5. Healing Tales Feature

The Healing Tales feature allows users to provide prompts and information to generate personalized stories using artificial intelligence (AI). By using this feature, you acknowledge and agree to the following:

• AI Generation: The tales are generated by an AI model (currently Anthropic) based on the inputs you provide. While we strive for meaningful content, the output is AI-generated and may contain inaccuracies, inconsistencies, or unexpected content. We do not guarantee the quality, accuracy, suitability, or therapeutic value of any generated tale.
• User Input Responsibility: You are solely responsible for the information, prompts, and personal narratives you provide for tale generation. Do not submit information that infringes on third-party rights, is unlawful, or violates these Terms. By submitting information, you grant us the necessary rights to use it (and transmit it to our AI partner) solely for the purpose of generating your requested tale.
• Intended Audience & Interpretation: Healing Tales are intended for personal reflection and exploration by adults (18 years or older). They are not a substitute for professional therapy, counseling, or medical advice. Any interpretation, application, or emotional response to a tale is solely the responsibility of the reader. If a tale is shared with or read to a minor, it must be done under the supervision of a responsible adult who actively monitors the minor's understanding and reaction. If a tale evokes strong emotions or distress (in an adult or minor), please seek support from a qualified professional.
• Disclaimer of Liability: To the fullest extent permitted by law, Family Roots disclaims all liability for any direct, indirect, incidental, consequential, or special damages arising out of or in connection with your use of the Healing Tales feature, including reading, interpreting, or sharing any generated tale. This includes, but is not limited to, any emotional distress, psychological impact, or decisions made based on the tale's content.
• No Therapeutic Relationship: Use of the Healing Tales feature does not create a therapist-patient or any other professional therapeutic relationship between you and Family Roots or its AI partners.

6. Intellectual Property

• Our Content: The Service and its original content (excluding User Content and AI-generated Healing Tales), features, and functionality are and will remain the exclusive property of Family Roots and its licensors. The Service is protected by copyright, trademark, and other laws.
• User Content: You retain ownership of any information you submit (User Content).
• Healing Tales Content: Subject to your ownership of the original input prompts, the ownership of the AI-generated tale content itself may be subject to the terms of our AI partner (Anthropic) and applicable law regarding AI-generated works. We grant you a limited, non-exclusive license to use the generated tales for personal, non-commercial purposes, subject to these Terms.

7. Fees and Payment (If Applicable)

8. Disclaimers

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT ANY WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE.

9. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT WILL FAMILY ROOTS, ITS AFFILIATES, LICENSORS, SERVICE PROVIDERS, EMPLOYEES, AGENTS, OFFICERS, OR DIRECTORS BE LIABLE FOR DAMAGES OF ANY KIND, UNDER ANY LEGAL THEORY, ARISING OUT OF OR IN CONNECTION WITH YOUR USE, OR INABILITY TO USE, THE SERVICE, ANY WEBSITES LINKED TO IT, ANY CONTENT ON THE SERVICE, INCLUDING ANY DIRECT, INDIRECT, SPECIAL, INCIDENTAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO, PERSONAL INJURY, PAIN AND SUFFERING, EMOTIONAL DISTRESS, LOSS OF REVENUE, LOSS OF PROFITS, LOSS OF BUSINESS OR ANTICIPATED SAVINGS, LOSS OF USE, LOSS OF GOODWILL, LOSS OF DATA, AND WHETHER CAUSED BY TORT (INCLUDING NEGLIGENCE), BREACH OF CONTRACT, OR OTHERWISE, EVEN IF FORESEEABLE.

10. Indemnification

You agree to defend, indemnify, and hold harmless Family Roots, its affiliates, licensors, and service providers, and its and their respective officers, directors, employees, contractors, agents, licensors, suppliers, successors, and assigns from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to your violation of these Terms or your use of the Service, including, but not limited to, your User Content and use of Healing Tales, other than as expressly authorized in these Terms.

11. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of Poland, without regard to its conflict of law provisions.

You agree to submit to the personal and exclusive jurisdiction of the courts located within Toruń, Poland to resolve any dispute or claim arising from these Terms or the Service.

12. Changes to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will provide reasonable notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion. By continuing to access or use our Service after any revisions become effective, you agree to be bound by the revised terms.
